SUMMARY OF ORDINANCE NO. 1216 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOS BANOS AMENDING AND RESTATING ARTICLE 30 CHAPTER 3 OF TITLE 9 OF THE LOS BANOS MUNICIPAL CODE RELATING TO ACCESSORY DWELLING UNITS TO IMPLEMENT NEW STATE LAW REQUIREMENTS RELATING TO ACCESSORY DWELLING UNITS On May 20, 2026 the Los Banos City Council introduced Ordinance No. 1216, which if adopted will affirm regulations and procedures for reviewing and permitting Accessory Dwelling Units and Junior Accessory Dwelling Units through a ministerial process consistent with Government Code 66314 (accessory dwelling units) and 66333 (junior accessory dwelling units). This Ordinance amends and restates the City of Los Banos Municipal Code regulations governing Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs) to ensure consistency with recent changes to California State law, including Government Code SS 65852.2 and SS 65852.22, as amended by Senate Bill 13 and Assembly Bills 68 and 881.The Ordinance establishes updated standards and procedures for the development of ADUs and JADUs, including permitting such units ministerially on residentially zoned properties with an existing or proposed dwelling. The Ordinance defines allowable unit types, development standards (including size, setbacks, height, and design), parking requirements, utility connections, and applicable fees. It also prohibits the separate sale of ADUs and restricts short-term rentals of such units. The Ordinance shall go into effect and be in full force and operation thirty (30) days after its final passage and adoption.
