NOTICE OF PUBLIC HEARING ESCALON PLANNING COMMISSION NOTICE IS HEREBY GIVEN that the City of Escalon Planning Commission will hold a public hearing in the Council Chambers, City Hall, 2060 McHenry Ave, Escalon, California, on Tuesday, July 14, 2026 at 6:30 PM to receive and consider evidence and reports relative to the following matters: RELIGIOUS INSTITUTION OVERLAY (RIO) ZONING AMENDMENTS The Planning Commission will consider a Resolution recommending that the City Council of the City amend both the text of the Municipal Code and the City's Zoning Map to add provisions for the development of specified affordable housing projects on religious institution (church) sites within the City. Churches are already allowed to develop higher-density affordable housing on their properties under state law. Establishment of the RIO Overlay District would set forth the standards for such development and provide certain incentives to encourage it. The parcels to be considered for rezoning to add the RIO Overlay District are: APN 247-150-43 1511 Catherine Way APN 225-020-18 1155 Escalon Avenue APN 227-260-27 2149 Jackson Avenue ZONING TEXT AMENDMENT TO ADD PROVISIONS FOR RE-USE OF HOUSING SITES State law specifies that when certain sites are listed in the City's Housing Element sites inventory for more than one Housing Element cycle, housing development proposed on those sites must be allowed "by right" if at least 20% of the project units are provided as affordable to lower-income households. To comply with this requirement, the Planning Commission will consider a resolution recommending that the City Council amend its Zoning Code to add footnotes specifying that notwithstanding the uses shown in the subsection SS 17.16, development of housing projects proposed on sites that have been previously been listed in the City's Housing Elements (APN 225-100-08, 1124 E. California St.) shall be permitted by-right, subject only to ministerial review and the standards set forth in subsection SS 17.16. ZONING TEXT AMENDMENTS TO IMPLEMENT HOUSING ELEMENT PROGRAMS The Planning Commission will consider a series of Zoning Code text amendments to implement programs contained in the City's adopted Housing Element and to ensure consistency with State housing law. The proposed amendments address a variety of housing-related topics intended to facilitate housing production, expand housing opportunities, and remove regulatory constraints. The following table provides a summary of each proposed amendment, including a description of the change and the corresponding section(s) of the Zoning Code affected: Description of Change - Zoning Code Sections to be Changed Changes to List of Permitted Uses Table to add "Permanent Supportive Housing" as a permitted use by right in by-right use in R-3, C-2, and C-M Zones and amend its definition in the "Definitions" section. : Section 17.11.040 (List of Permitted Uses Table); Section 17.81 (Definitions) (Ordinance Exhibits A and B) Changes to List of Permitted Uses Table to add "Low Barrier Navigation Centers" as a permitted use by-right in R-3, C-2, and C-M and add its definition to the "Definitions" section. : Section 17.11.040 (List of Permitted Uses Table); Section 17.81 (Definitions) (Ordinance Exhibits A and B) Changes to List of Permitted Uses Table to amend "Employee Housing" and amend its definition to the "Definitions" section. : Section 17.11.040 (List of Permitted Uses Table); Section 17.81 (Definitions) (Ordinance Exhibits A and B) Changes to Section 17.411.140 (Accessory Dwelling Units). : Section 17.411.140 (Accessory Dwelling Units) (Ordinance Exhibit C) Changes to List of Permitted Uses Table to amend "Residential Care Facilities" to apply objective design standards to facilities serving seven or more clients. : Section 17.11.040 (List of Permitted Uses Table) (Ordinance Exhibit A) Changes to List of Permitted Uses Table to amend "Manufactured Homes" to ensure they are subject to same standards as other single-family residential uses. : Section 17.11.040 (List of Permitted Uses Table) (Ordinance Exhibit A) Changes to Section 17.81.070 (Definitions) to amend definition of "Family" and ensure occupancy standards comply with fair housing law. : Section 17.81 (Definitions) (Ordinance Exhibits A and B) Changes to Section 17.43.020 (Number of off-street spaces required) to create a minimum parking requirements table and update residential parking minimums to comply with State law. : Section 17.43.020 (Number of off-street spaces required) and Section 17.81 (Definitions) (Ordinance Exhibits E and B) Changes to Section 17.48 (Density Bonus) to reflect updates to State law. : Section 17.48 (Density Bonus) (Ordinance Exhibit D) Environmental Review: The City of Escalon as the lead agency has determined that the proposed project is statutorily exempt from further review under the California Environmental Quality Act (CEQA) in accordance with section 21080.85 of the Public Resources Code, which exempts local governments from CEQA review for rezoning projects that align with and implement their adopted Housing Elements. AT THE ABOVE HEARING, INTERESTED INDIVIDUALS will be given an opportunity to express opinions or speak in favor or opposition to the above proposal. Written comments filed prior to the meeting will be accepted by the Development Services Department. Information regarding the hearing is on file with the City and may be viewed by interested individuals at the office of the Development Services Department. Notice is further given that the time within which judicial review must be sought may be subject to the short time limitations contained in California Code of Civil Procedure section 1084 et seq., including but not limited to, Code of Civil Procedure section 1094.6. All interested parties are invited to attend said hearing and express opinions or submit evidence for or against the proposal as outlined above.
